Agreement to terms
These Terms of Service govern your access to and use of the Mooshfy website and services. By using our site or engaging us, you agree to these terms. Where local law requires specific terms, those are provided on the relevant country site.
Our services
Mooshfy provides Shopify design, development, migration, and marketing services. The specific scope, deliverables, timeline, and fees for any engagement are set out in a separate written proposal or agreement, which takes precedence over these general terms for that engagement.
Quotes and payment
We provide fixed quotes before work begins. Payment terms, milestones, and any deposits are defined in your project agreement. Fees are exclusive of applicable taxes unless stated otherwise.
Intellectual property
On full payment, the deliverables we create specifically for you are yours to keep, as defined in your agreement. Pre-existing tools, libraries, and know-how we use to build them remain ours. Our website content and branding remain the property of Mooshfy.
Client responsibilities
You agree to provide timely access, content, and feedback needed to deliver the work, and to ensure that any materials you supply do not infringe third-party rights.
Warranties and liability
We deliver our services with reasonable skill and care. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any engagement is limited to the fees paid for it.
Third-party platforms
Our work relies on third-party platforms such as Shopify and its apps. We are not responsible for those platforms’ availability, pricing, or policy changes, though we help you navigate them.
Termination
Either party may end an engagement as set out in the project agreement. You remain responsible for fees for work completed up to termination.
Changes to these terms
We may update these terms from time to time. Continued use of our site or services after changes take effect constitutes acceptance of the updated terms.
