By accessing and using Mooshfy POS ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service
Mooshfy POS is a cloud-based point-of-sale solution that provides businesses with tools for inventory management, sales processing, tax compliance, customer management, and business reporting. The Service is provided on a subscription basis and may be accessed through web browsers and mobile applications.
3. User Accounts and Registration
To use the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription and Payment Terms
Monthly or annual billing. 30-day notice for price changes. Cancel anytime.
The Service is provided on a subscription basis. Subscription fees are billed in advance on a monthly or annual basis, as selected by you. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.
5. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable law or regulation
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service to transmit any malicious code or harmful content
- Reverse engineer, decompile, or disassemble any part of the Service
6. Data and Privacy
You retain all ownership rights to your data. We will not access, use, or disclose your data except as necessary to provide the Service, comply with legal obligations, or as you explicitly authorize. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Mooshfy and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
8. Service Availability and Modifications
High availability service. 99.9% uptime target. Offline mode supported.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
9. Limitation of Liability
To the maximum extent permitted by law, Mooshfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
10. Termination
Cancel anytime. No cancellation fees. Immediate account suspension for violations.
You may cancel your subscription at any time. We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice, if you breach these Terms or engage in any fraudulent, abusive, or illegal activity. Upon termination, your right to use the Service will cease immediately.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mooshfy operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
